End User License Agreement & Terms of Use

1. Acknowledgement & Parties
1.1. These Terms constitute a binding legal agreement between you and Andrei Kovalev (individual developer, Cyprus) ("Mixiebar", "we", "us"). Contact: support@mixiebar.com. By downloading, accessing, or using our cocktail and mixology mobile application, currently branded as Mixiebar (the "App"), you agree to these Terms.
1.2. Apple & Google: You acknowledge that this agreement is between you and Mixiebar only, not with Apple Inc. or Google LLC. We are solely responsible for the App and its content. Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms.
1.3. Consumer Rights: Nothing in these Terms affects your mandatory statutory rights as a consumer under the laws of your jurisdiction.
1.4. Privacy: Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your data.
2. License Grant & Restrictions
2.1. License: We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App strictly in accordance with these Terms.
2.2. Restrictions: You agree not to copy, reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. You must not rent, lease, loan, sell, sublicense, distribute, or circumvent any security measures.
2.3. Intellectual Property: The App's design, trademarks, recipe content, curated selections, user interface, branding, and code ("App Content") are owned by Mixiebar or its licensors and are protected by applicable intellectual property laws.
2.4. Content Sharing & Attribution:
- Permitted Sharing (organic): You may share individual images, screenshots, or short excerpts on social media provided that you:
- a) Provide clear attribution to Mixiebar
- b) Do not suggest affiliation with or endorsement by Mixiebar
- c) Do not remove watermarks or branding
- d) "Short excerpts" means limited portions, not complete recipe sets
- Business Accounts: Organic posts by business accounts are allowed under the same conditions, as long as the post is not paid, sponsored, or boosted.
- Prohibited Commercial Use: You may not use App Content for printed or digital menus, paid ads, commercial publications, competing apps, mass extraction, or building a substitute recipe library.

3. Safety & Alcohol Policy
3.1. Strict 18+ Policy: The App is intended solely for users who are at least 18 years old (or the legal drinking age in your jurisdiction). If you are under this age, you are prohibited from using the App.
3.2. Health & Safety Disclaimer: NEVER DRINK AND DRIVE. Recipes and AI suggestions are for informational purposes only. You are solely responsible for verifying ingredients, alcohol content, allergens, preparation methods, and other important safety details before use or consumption.
4. Subscriptions & Billing
4.1. Store Terms Control Billing: Subscriptions are purchased via Apple (App Store) or Google (Play Store). Billing, cancellation, renewals, trials, and refunds are governed by the relevant Store's terms.
4.2. Auto-Renewal: Subscriptions renew automatically unless disabled in your Store Settings at least 24 hours before the end of the current billing period.
4.3. Deletion ≠ Cancellation: Uninstalling the App does not cancel your subscription. You must cancel through your Store account settings.
4.4. Refunds: Refund eligibility is determined by the relevant Store and applicable law.
4.5. Free vs Premium Features: Free users have access to basic features and limited AI usage. Premium subscribers receive broader access and higher AI usage limits. From time to time, we may also offer introductory, promotional, trial, bonus, or welcome AI access or credits, and eligibility for such offers may be limited at our discretion, including by device, installation, promotion, region, subscription status, or other anti-abuse criteria.
5. AI Features & Requests
5.1. AI Functionality: The App offers AI-powered features such as cocktail recommendations and ingredient suggestions. These are provided through third-party AI providers and may not always be accurate, suitable, or complete.
5.2. AI Request Limits: AI usage may be limited to ensure fair use and service stability.
- Free Users: Receive limited AI access.
- Premium Users: Receive higher AI access limits, subject to fair use.
- How requests are counted: Standard queries count as one request; resource-intensive features may count differently.
- When a limit is reached: AI features may become temporarily unavailable until reset, renewal, upgrade, or other eligibility changes determined by us.
- Introductory / Promotional Access: We may offer one-time or limited introductory, promotional, trial, bonus, or welcome AI access or credits. Such access may be granted only once per eligible device, installation, promotion, or other eligibility unit determined by us.
- No Reset Guarantee: Reinstalling the App, deleting local data, deleting app data, clearing history, or obtaining a new installation identifier does not guarantee renewed eligibility for introductory, promotional, trial, bonus, or welcome AI access or credits.
5.3. Operational Flexibility: We may adjust limits, reset times, counting rules, feature availability, technical parameters, eligibility criteria, or AI providers to operate the service efficiently, including for abuse prevention, capacity management, cost control, fraud prevention, and enforcement of introductory or promotional AI access rules. We may use installation-level or device-level checks to enforce such rules. Material changes to paid subscription benefits will be communicated per Section 12.1 where required by applicable law.
5.4. Content Responsibility: AI-generated content is provided for informational purposes. You are solely responsible for reviewing and verifying all AI-generated content before use. AI may make mistakes.
5.5. Prohibited Use: You must not use AI features to:
- Generate illegal, harmful, violent, dangerous, or offensive content
- Request instructions for breaking laws or dangerous activities
- Bypass, exploit, or attempt to circumvent AI request limits, introductory or promotional access rules, or other technical or usage restrictions, including through reinstalling the App, deleting data, resetting identifiers, or similar methods
- Impersonate others
- Engage in automated scraping or bot-driven requests
- Extract a substitute recipe database for commercial purposes
5.6. AI-Generated Content Ownership: We do not claim ownership of your specific AI interactions, but AI output is not exclusive to you. We do not use your queries to train our own proprietary models, though third-party AI providers may process requests under their own terms.
5.7. Third-Party AI Processing: AI queries are processed by third-party providers. We do not generally store your full AI conversation content on our servers. However, we may temporarily store prompts and the related AI responses associated with failed, empty, blocked, invalid, or clearly low-quality AI responses, including when you explicitly provide negative feedback on an AI reply, together with limited technical metadata and feedback signals, for debugging and service improvement, as described in our Privacy Policy. AI providers' processing is governed by their own terms.
5.8. AI Response Feedback: The App includes optional thumbs up / thumbs down feedback on AI responses. Tapping thumbs down may trigger temporary storage of the related prompt and the full AI response for quality review. Tapping thumbs up may be recorded as an aggregated or minimal helpfulness signal, without requiring storage of the full prompt or response content for that action.
5.9. Service Improvement: We may analyze aggregated or de-identified AI usage patterns and feedback trends to improve prompts, flows, and suggested actions in the App, including surfacing common request types as shortcuts or buttons.
6. User Content & Local Storage
6.1. Local Data: The App allows you to create custom recipes, add photos, save notes, and maintain your Mixie AI request history ("User Content"). This is generally stored locally on your device.
6.2. Limited Server Review: In limited cases, prompts and the related AI responses associated with failed, empty, blocked, invalid, or clearly low-quality AI responses, including cases where you explicitly submit negative feedback on an AI reply, may be temporarily processed and stored on our servers for debugging and quality improvement, as described in our Privacy Policy.
6.3. Ownership: You retain your rights in User Content you create.
6.4. Automatic Device Backups: Your device may back up App data to your personal cloud storage. We do not control this.
6.5. Data Loss: You are solely responsible for backing up your User Content.
6.6. Deleting Mixie AI History: You can delete your Mixie AI request history via Settings → Privacy → Clear AI request history. This action is permanent.
7. Maintenance, Support & Communications
7.1. Developer Responsibility: Contact us at support@mixiebar.com for issues, bug reports, or feature requests.
7.2. No Store Obligation: Apple and Google have no obligation to provide maintenance or support.
7.3. Communications: We may send service-related, product-related, and promotional communications as described in our Privacy Policy. You can opt out of marketing emails using the unsubscribe link.
8. Termination & Suspension
8.1. Termination by You: You may stop using the App at any time. Cancel subscriptions separately via your Store settings.
8.2. Termination by Us: We may suspend or terminate access if you violate these Terms, misuse the service, attempt to bypass usage limits or promotional access rules, or pose a security risk.
8.3. Effect: Upon termination, your license ends immediately. Provisions that by nature should survive will remain in effect.
8.4. Refunds Upon Termination: Determined by applicable law and Store policy.
9. Disclaimer of Warranties
9.1. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND ACCURACY.
9.2. EU/EEA Consumer Rights: This disclaimer does not affect your mandatory statutory rights.
10. Limitation of Liability
10.1. Our total liability is limited to the amount you paid us in the 12 months preceding the claim, or €50 if no payment was made.
10.2. We are not liable for indirect, incidental, consequential, special, or punitive damages.
10.3. Nothing excludes liability that cannot be excluded under applicable law.
11. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless Mixiebar from claims arising out of: (a) your use of the App; (b) your violation of these Terms; (c) your violation of third-party rights; or (d) your unauthorized commercial use of App Content.
12. Changes & Assignment
12.1. Changes to Terms: We may update these Terms. Material changes that affect your rights, subscription benefits, or data processing will be communicated in the App, by email, push notification, or other reasonable means.
12.2. Assignment: We may assign our rights and obligations. You may not assign these Terms without our written consent.
13. Governing Law & Dispute Resolution
13.1. These Terms are governed by the laws of the Republic of Cyprus.
13.2. EU/EEA and UK consumers: You retain your right to rely on mandatory consumer protection provisions. Disputes may be brought in the courts of your country of residence or Cyprus.
13.3. Non-EU users: Disputes are subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.
13.4. Alternative Dispute Resolution: EU/EEA consumers may have access to certified ADR bodies. Contact us first at support@mixiebar.com.
14. Severability & Entire Agreement
14.1. If any provision is found unenforceable, the remaining provisions remain in full force.
14.2. These Terms constitute the entire agreement between you and Mixiebar regarding the App.
